MINUTES
The Elkton City Council met in special session on Tuesday, May 29, 2007 with Mayor Nancy T. Camp presiding. City Council members present: Doug Gibson; Eugene Jefferson; David Powell; and Robin Snardon. City Council members absent: Danny Laster; and Cindy Sidebottom. Others present: City Clerk/Treasurer Laura Brock; and, City Attorney John P. Kirkham. Mayor Camp called the meeting to order at 6:00 PM. Clerk Brock explained that she received a request from an insurance company to refund insurance premium taxes paid to the City erroneously. The company went back six years to calculate their request for a refund of about $4,000. Mr. Kirkham explained that this company, as well as several more in the State, is under review for their collection practices. Many around the State believe that more requests for refunds will be made by other companies in the near future. Therefore, Mr. Kirkham and Clerk Brock recommended passing an ordinance limiting the amount of time a company can go back and request a refund. Also, the ordinance sets out what information the City would require to process the refund and states that a credit for future payments can be required by the City instead of issuing a refund. After discussion, Clerk Brock read first reading of Ordinance 2007-4, "AN ORDINANCE AMENDING CHAPTER 115 OF THE CODE OF ORDINANCES OF THE CITY OF ELKTON, KENTUCKY, DEALING WITH AN INSURANCE PREMIUM TAX ON INSURANCE COMPANIES OR BROKERS DOING BUSINESS WITHIN THE CITY, ADDING AN ADDITIONAL SECTION REGULATING REQUESTS FOR REFUNDS." Mr. Jefferson motioned to approve after first reading and seconded by Mr. Powell. Motion carried unanimously by show of hands. Mr. Jefferson motioned to adjourn and seconded by Mr. Powell. Motion carried unanimously. Meeting adjourned at 6:20 PM. |
