Elkton City Council Special Meeting 
Thursday, March 20, 2008

The Elkton City Council met in special session on Thursday, March 20, 2008 with Mayor Nancy T. Camp presiding.

City Council members present: Doug Gibson; Eugene Jefferson; Danny Laster; Cindy Sidebottom; and, Jimmy Scott.

City Council members absent: David Powell.

Others present: City Clerk/Treasurer Laura Brock; Utility Superintendent Terry Frogue; and Watson Ricchuite.

Mayor Camp called the meeting to order at 5:00 PM.

Clerk Brock read second reading of Ordinance 2008-2, "AN ORDINANCE AMENDING §151.17(A) AND §151.47(A)(23) OF THE ZONING ORDINANCES OF THE CITY OF ELKTON, KENTUCKY." Mr. Jefferson motioned to adopt after second reading and seconded by Mr. Gibson. Motion carried unanimously by show of hands.

Mayor Camp stated that although it had been approved for the City to purchase a tractor to mow right-of-ways in the City, several council members requested this topic be brought back up for discussion. Mr. Jefferson stated that he was having second thoughts about the liability of using the jail inmates. Mayor Camp stated that she, Mr. Kirkham, Terry Frogue and Clerk Brock met with the County Attorney and Jailer to discuss the liability issue. It was concluded from this meeting that the City was only liable if we were negligent in our supervision, but all medical expenses and injuries would still be the responsibility of the Todd County Jail. Several of the council members questioned if the Utility Department had time to do this work. Mr. Frogue stated they did not need any extra work, but they would do what needed to be done. Mayor Camp presented a list of city property and street right-of-ways that need to be mowed. Watson Ricchuite, who mowed for the City last year, presented a bid of $981.20 to mow every two weeks. There was also discussion about the need for a mower at the sewer plant. After some discussion, Mrs. Sidebottom motioned to contract with Watson Ricchuite for mowing right-of-ways. Motion seconded by Mr. Scott. Those voting in favor of the motion were Gibson, Jefferson, Scott and Sidebottom. Voting opposed was Laster. Motion carried.

Regarding the mower for the sewer plant, Clerk Brock stated that it may be possible to purchase a mower through remaining sewer project grant funds, but that it would need to be approved through Rural Development. Mrs. Sidebottom motioned to approve the purchase of a zero turn mower through remaining sewer project funds if it is acceptable to Rural Development. Mr. Jefferson seconded the motion. Those voting in favor of the motion were Gibson, Jefferson, Scott and Sidebottom. Mr. Laster abstained and therefore motion carried.

Clerk Brock questioned if Watson Ricchuite’s bid included mowing the Fire Department. He stated it did not. Therefore, after discussion, Mayor Camp requested Watson Ricchuite place a bid to mow the Fire Department lot. A bid will also be taken from Marvin Bell, who currently mows the lot. Mr. Laster stated he knows someone who would like to bid on it as well. Since this work does not require a public bid, bids will be requested from these people by Monday, March 24th and all the Council members were requested to come by City Hall to review the bids and make a recommendation.

Mr. Jefferson motioned to adjourn and seconded by Mr. Gibson. Motion carried unanimously and the meeting adjourned at approximately 5:30 PM.
