Update: February 21, 2012 - The renovation of the concession/restroom building was publicly bid and awarded to the lowest bidder, Circle C Construction from Russellville, KY. Renovations began in December 2011 and were completed in February 2012.

October 25, 2011 - As a part of the LWCF Grant project, the City of Elkton has awarded a competitively bid construction contract to Circle C Construction to completely renovate the concession and restroom building at the City-County Park. Renovations will begin in November and are expected to be completed by February 2012.

May 4, 2011 - The City of Elkton and Todd County governments partnered with the Church of Jesus Christ of Latter-Day Saints for a "Day of Service" project titled "Pitching in for a Better Park" to make improvements to the City-County Park using volunteer labor. Monday, July 26, 2010 - Governor Steve Beshear announced that the Elkton-Todd County Park was awarded a $65,000 Land and Water Conservation Fund Grant for improvements to the Park. The grant requires the Elkton-Todd County Park to match the grant with an additional $65,000 in cash or in-kind labor and goods for a total project of $130,000.

Improvements that will be made in the park include complete remodeling of the restroom facilities, renovation or replacement of two pavilions, skate park ramp repairs, fence repairs, dugout roof repairs, play equipment repaired or replaced, and installation of ADA accessible play equipment.

Veterans Day Service

Homeland Security Grant

Elkton Bike Night - Each year, hundreds of motorcycles line Public Square every Thursday night for Elkton Bike Night. Even if you don't have a motorcycle, many people come to “t
he Square” just to visit and enjoy the live entertainment.

The Todd County Community Alliance, a nonprofit membership organization established to promote Todd County, Kentucky, has already lined up live entertainment every Thursday night on Public Square from April 7th to September 29th. Other entertainment scheduled for later in the year includes additional performances by Five Star Band and the bands Midlife Crisis and Family Gospel and music by Clay Bilyeu and Sons of the South.

Food vendors, including Coy’s Barbeque, Backwoods Grilling and Brenda’s Snack Shack are already planning to set up near Public Square on Bike Night. Local restaurants will also have Bike Night specials. According to Bike Night Committee Chairman, Robert Brown, “Other vendors, church groups, Relay for Life teams are also welcome and encouraged to set up. They just need to contact me to work out the details of setting up and I will help them find a location to set up.”

Extravaganza and Carnival - Thursday, April 28th through Saturday, April 30th. Carnival rides, "everyone wins midway games,"vendor booths and yard sale booths begin Thursday afternoon on the old Elkton Die Casting property located on West Jefferson Street in Elkton and goes through Saturday night. Friday night also includes a free "Spring Scramble Dance" with live band. Additional Saturday events include free pictures on the egg chair, egg games for children and free egg cooking samples. Admission on the event grounds is free, however charges apply to carnival rides and everybody wins midway games.

Saturday Rides "Tour of Todd County" - The Elkton Bike Night Committee is also scheduling a monthly “Saturday Ride” in Todd County. Each ride will start at 10:00 am on Public Square in Elkton and will continue through Todd County ending at a different location each month.

The first “Saturday Ride” will be April 16th and will end at Shady Cliff Restaurant at Lake Malone. Other rides later in the year will end in Kirkmansville, Guthrie, Trenton and Clifty.      HarvestFest - Thursday, September 29th through Saturday, October 1st. HarvestFest kicks off with the final Elkton Bike Night of the year and always features a live band. This year, Five Star Band will end the year in style with a live concert on the Square.
     Friday will bring a new event with a "Square Dance." Put on your dancing shoes and getting ready to boogie on Public Square with entertainment by a live band to be announced.
     Finally, HarvestFest really begins Saturday morning at 9 am when Public Square is closed down to vehicles and street vendors line Public Square selling arts and crafts, home decor, candles, homemade baked goods, jellies, jams, funnel cakes, clothing, purses, hamburgers and much, much more! While you shop around the Square, you can enjoy free live music on the Main Stage. Once the vendors clear out on Public Square at 3 PM, the final "Cruise in on the Square" will take over for the final night of the year.
     New for 2011, there will be various carnival rides at the old Elkton Die Casting property on West Jefferson Street starting Thursday evening through Saturday night.

Christmas in Elkton - Friday, December 2nd. Many local businesses have all day sales, refreshments and give-a-ways. The annual Christmas decoration lighting ceremony will begin at approximately 5:00 PM with Christmas carols and free refreshments in the Historic Todd County Welcome Center. Santa Claus will arrive at the Milliken Memorial Community House at about 6:00 PM. Also in the Community House, free pictures with Santa, children's activities and refreshments. Free horse drawn carriage rides from 6 to 9 pm.

November 14, 2011 Council Meeting Minutes

The Elkton City Council met in regular session on Monday, November 14, 2011 with Mayor Nancy T. Camp presiding.

City Council members present: Doug Gibson; Eugene Jefferson; Jimmy Scott; Danny Laster; David Powell; and, Cindy Sidebottom.

Others present: City Clerk/Treasurer Laura Brock; Utility Superintendent Terry Frogue; Police Chief Bruce Marklin; Mr. Robert Johnson; Leslie Rager, Hearthstone Place; John Davis, Air Evac; Mike Calvin and Bruce Powell, Fastnet Wireless; Catherine Darnell, Todd County Standard; and, Marie Fainter, WHOP Radio.

Mayor Camp called the meeting to order at 7:00 PM and led the pledge of allegiance. Mr. David Powell gave invocation.

After reviewing the minutes of the October 10, 2011 council meeting, bills payable and financial reports, Mr. Laster motioned to approve, seconded by Mr. Scott and carried unanimously.

Mayor Camp welcomed John Davis with Air Evac. Mr. Davis explained that Air Evac is a private air ambulance company that has been located in Hopkinsville for 12 years. He is proposing the city purchase a membership for all city employees at a discounted rate of $40 per single, $45 per couple and $50 for three or more. Or, at least offer a payroll deduction to the employees to purchase a membership. After discussion, Mr. Davis thanked the council for their time.

Mayor Camp introduced Mike Calvin and Bruce Powell with Fastnet Wireless. Clerk Brock presented quotes for installing new WiFi internet on Public Square and in the City-County Park. Cornerstone Information Systems, $9,000; Green River Technologies, $5,244; and Fastnet Wireless, $3,288 to $4,199. Mr. Calvin explained his company’s experience and answered questions about the service that would be provided. After discussion, Mr. Calvin and Mr. Powell thanked the council and left the meeting along with Mr. Davis.

Mayor Camp requested the council amend the agenda to allow Mrs. Leslie Rager to address the council. Mr. Scott motioned to approve and seconded by Mr. Laster. Motion carried unanimously. Mrs. Rager explained that she was present on behalf of the residents at Hearthstone Place nursing home in Elkton who are concerned that there are no sidewalks to the nursing home. They have one resident in a wheelchair that is alert and likes to leave the facility. Because there are no sidewalks he travels in the road all the way to town. If the resident is alert and has the ability to leave the facility on their own, they must allow them to do so. However, due to safety concerns, they have had to stop allowing this gentleman to leave. Mrs. Rager stated she realizes it will be expensive, but she and the residents hope the council will consider installing sidewalks in the area. She presented a petition signed by many of the residents. She thanked the council and left the meeting.

Mayor Camp reported that Mr. Robert Downey with Woodmen Insurance donated three trees and mulch for Glenwood Cemetery. He and Mayor Camp will also present a “good neighbor award” to Mr. Kenny Clayton. The presentation will be held this Saturday at 8 am at The Gathering Place in Elkton. Woodmen Insurance will also make a donation to the charity of Mr. Clayton’s choice.

Mayor Camp reported the Elkton Planning Commission held a public hearing and discussed the proposed annexation of 6.049 acres on B. White Road. Clerk Brock read a report from the Planning Commission that recommended the property be annexed and that it be zoned Residential District R-1 upon its annexation. Ms. Sidebottom motioned to approve the recommendation and seconded by Mr. Jefferson. Motion carried unanimously.

Clerk Brock read first reading of Ordinance 2011-13, “AN ORDINANCE ANNEXING 6.049 ACRES OF UNINCORPORATED TERRITORY INTO THE CITY OF ELKTON, AND ESTABLISHING ZONING FOR THE NEWLY ANNEXED AREA (DILLY TURNER, AND JOEY WELLS PROPERTY).” Mr. Jefferson motioned to accept after first reading and seconded by Mr. Powell. Motion carried by unanimous show of hands.

Resolution 2011-5, “A RESOLUTION OF THE CITY OF ELKTON, KENTUCKY AUTHORIZING THE MAYOR TO MAKE APPLICATION FOR AND, UPON APPROVAL, TO ENTER INTO AN AGREEMENT WITH THE KENTUCKY OFFICE OF HOMELAND SECURITY (KOHS), TO EXECUTE ANY DOCUMENTS WHICH ARE DEEMED NECESSARY BY KOHS TO FACILITATE AND ADMINISTER THE PROJECT AND TO ACT AS THE AUTHORIZED CORRESPODENT FOR THIS PROJECT ” was presented to the council. Clerk Brock stated this resolution allows the Mayor to enter into an agreement with the state for the $25,000 Homeland Security grant the city was recently awarded for the purchase of turnout gear and SCBA devices. After discussion, Mr. Powell motioned to adopt Resolution 2011-5 and seconded by Mr. Gibson. Motion carried unanimously.

Mayor Camp reported the clock in the Historic Courthouse was briefly working last week. The company repairing the clock is still working out some programming bugs and it should be working shortly.

Mayor Camp reported the Todd County Industrial Foundation met recently and Mr. Jefferson also attended on behalf of the council. Mayor Camp and Mr. Jefferson stated nothing could be reported from the meeting because most of the meeting was held in executive session.

Christmas in Elkton will be held Friday, December 2nd with Santa Claus visiting the Community House and caroling on the Square. There will be carriage rides from the Courthouse and from the Community House.

Mayor Camp reported Keith Sharp, Architect, looked over the bids the city received for cleaning up the Elkton Die Casting property. He reported to Mayor Camp that the bid received from Rabold Environmental ($34,600.00) seemed to be a good bid for what we wanted done. Mayor Camp also spoke with Donald Settle who is still interested in using the building for a training center. Mayor Camp also reported that Governor Beshear has stated that only communities that are “work ready communities” will be promoted by the state to new industries. Communities must have a plan in place in three years. Clerk Brock was asked if this project was in the budget and she stated it was not. Mr. Scott was concerned that no one was immediately ready to use the building and that additional work on top of this would be needed to get the building ready. There is conflicting information if the building is eligible for a Brownfield Grant. Clerk Brock stated that she was told that because there has not been a Phase I and Phase II study of the building, then we are not eligible. She can apply for both of these studies, which are done by the state for free on a first come first serve basis. It was the consensus of the council to apply for the Phase I and Phase II studies.

COUNCIL REPORTS

Mr. Jefferson called for a report from Police Chief Marklin. Chief Marklin reported Officer Will Meyers has successfully completed his six month probationary period. He also reported the new vehicle ordered for the department should be delivered in the next few weeks. He reported on Police Department activity in October. Also, Sargent Atkinson is attending firearms training this week through the National Rifle Association.

Mr. Scott reported all sports have been completed in the park this year. Demolition on the inside of the restrooms/concessions building has started with construction expected to begin next week.

Mr. Laster reported water loss this month was just over 8%. The same month last year was about 36%. This is a savings of about $9,000 in just one month. Mr. Frogue reported there is still work to be done to install master meters around town and other work to stay on top of the water loss. Frogue reported a water main break a few weeks ago that was found on a Sunday but the city was not notified until Monday.

Mr. Frogue updated the council on Riverbend Subdivision. Mr. Overholt met with the Planning Commission, who gave permission for Mr. Overholt to continue building the first house. There were several conditions that must be met before another house can be started. Mr. Kondraki, the engineer that designed the retention basin, has been working with Terry and Mr. Overholt to make sure it is being constructed correctly. Mr. Overholt and Mr. Frogue inspected the gravel base on the street and found several places that need some gravel added before the base asphalt layer can be installed.

Mr. Frogue reported the Water District still wants to make system changes to separate from the city. Terry has spoken with the Chairman of Kentucky Rural Water who has made some good suggestions. He will come down and work with Terry and the Water District to come to a solution. There was still concern over the why the Water District wants to make these costly changes.

Mr. Powell reported there was only one fire run since the last meeting. And, Chief Darrin Cole and the department are all very excited and thankful for the grant that was received for the turnout gear and SCBA devices.

Ms. Sidebottom reported that Modern Woodmen have planted three trees in the cemetery. Also, paving work should get started this week according to Scotty’s.

MAYOR’S REPORT

Mayor Camp reported the Historic Todd County Preservation Society has postponed their Evening of Elegance event until March 3, 2012. The event will benefit needed repairs to the second floor of the Historic Courthouse.

Clerk Brock reported that Coffman Lighting performed a lighting audit in City Hall and Police Station. Just for doing the audit, the city received all new LED emergency lights and exit signs. As a result of the audit, Coffman is proposing that new energy efficient retrofit lights be installed in the Police Department with occupancy sensors so the lights will go off when no one is in the station. Total cost for installing the new lights in the Police Station, including a rebate from TVA, would be $3,038. Total estimated energy cost savings would be about $2,700 per year, so the project would pay for itself in 1.4 years. As for City Hall, the cost would be $3,102 with annual estimated savings of $2,189 so the project would pay for itself in 2.3 years. Clerk Brock stated these repairs are not in this year’s budget, but the program might still be available next July if the council wanted to consider it for next year.

Mr. Jefferson asked if a decision needs to be made about Air Evac memberships. After discussion, Mr. Powell motioned to purchase a membership for city employees. Motion seconded by Ms. Sidebottom and carried unanimously.

There was also more discussion regarding WiFi. Mr. Gibson motioned to approve the proposal of Fastnet Wirelsess in the amount of $4,015.50. Motion seconded by Ms. Sidebottom and carried unanimously. After further discussion, Mr. Scott motioned to allow access to the WiFi 24 hours a day for now and to block the use of pornographic and other illegal websites. Motion seconded by Mr. Laster and carried unanimously.

There was no further discussion, therefore Mr. Jefferson motioned to adjourn and seconded by Mr. Laster. Motion carried unanimously and meeting adjourned at approximately 8:15 PM.

After reviewing the minutes of the September 12, 2011 council meeting, minutes of the September 20, 2011 special council meeting, minutes of the September 26, 2011 special council meeting, minutes of the September 27, 2011 special council meeting, bills payable and financial reports, Ms. Sidebottom motioned to approve, seconded by Mr. Jefferson and carried unanimously.

Mayor Camp announced that Mr. Tim Pulley and Mr. John Davis were not in attendance, therefore those items on the agenda will be discussed at a later date.

Mayor Camp announced that the city received bids for “Asbestos Abatement, Lead Paint Removal and General Cleanup” at the Elkton Die Casting property on Friday, October 7, 2011, with the following bids received: Rabold Environmental, $34,600.00; AAA Remediation, $59, 729.00. Mayor Camp stated that the city may need to hire someone to watch over the project. Clerk Brock stated that this project is not in the current budget. There was discussion of whether Donald Settle and Doug Boley were still interested in using the building for an adult training center. After discussion, no action was taken.

Mayor Camp reported that bids were received for the “Concessions/Restroom Building Renovations” in the City-County Park on October 6, 2011 with the following bids received: Circle C Construction, $57,500.00; Haley Construction, $79,930.00. Clerk Brock stated this project is part of the Land and Water Conservation Grant the city received that is a 50/50 matching grant. Also, the Recreation Commission has money in savings to contribute to this project. Clerk Brock also reminded the council the grant agreement requires acceptance of the lowest bidder. After discussion, Mr. Scott motioned to accept the bid of Circle C Construction in the amount of $57,500.00. Motion seconded by Mr. Laster and carried unanimously.

COUNCIL REPORTS

Mr. Gibson reported the paving the state recently did in the city around the jail, courthouse, Baptist Church and other areas looks really good.

Mr. Jefferson called for a report from Police Chief Marklin, who reported on Police Department activity in September. Chief Marklin reported that Sargent Brian Atkinson is now a certified firearms instructor and he qualified all police officer last week. All officers must be qualified twice a year.

Mr. Scott reported football has about 92 children participating in the park.

Mr. Laster commended the department for maintaining about 5% water loss in the city over the last few months.

Mr. Frogue reported he and the Mayor received a letter from the Todd County Water District informing the city that the Water District voted to make system improvements to allow the District to operate on its own independently of the City. The District is notifying the city so that we can make plans for any changes to our system due to the Water District’s improvements. Frogue explained that this change would require the city to make several modifications to our system and that the city would need to hire an engineer to help plan these changes and to come up with a cost estimate. Frogue explained how the city lines are connected to the District lines and that over the years, the Water District and the City worked together when we purchased water from the county and that the county would not have been able to build and operate a water system unless Elkton had not agreed many years ago to participate with the county to build a water treatment plant and accept 55% of the water district debt for this construction. Frogue has tried to work with John Haley, District Superintendent, to come to an agreement to trade water lines and customers in the past to separate lines more, but no agreement could be made. There was discussion about what the motivation is behind requesting these changes when it does not seem necessary. There was also discussion if the District could legally require the city to make these changes. It was the consensus of the council the city did not need to do anything at this time. It was also suggested the Water District explain their motivation behind making these system changes.

Mr. Frogue reported that Arland Overholt has applied for a zoning permit for construction of a house in Riverbend Subdivision. The foundation for the house was already constructed before applying for the permit. And, as explained at a previous council meeting, Mr. Overholt has not met the Planning Commission requirement of constructing the street to the first six lots through the base layer of asphalt and submitting a letter of credit to the city for the top layer of asphalt. Therefore, Mr. Frogue will not be able to issue a zoning permit for the house. According to Cornerstone Real Estate, the house has already been sold. Mr. Frogue stated he wanted to update the council in case action is needed to be taken in the future.

Ms. Sidebottom reported that the Modern Woodmen of America will be planting trees in Glenwood cemetery next week. They are donating $250 for trees and $500 for mulching.

MAYOR’S REPORT

Mayor Camp recommended the city make their annual contribution of $10,000 to the Foundation that was budgeted for this year. Mayor Camp reported the new Industrial Foundation sign has been put up on Highway 68/80. After considerable discussion, Mr. Powell motioned to contribute $10,000 to the Industrial Foundation and seconded by Mr. Laster. Voting in favor of the motion were Gibson, Jefferson, Scott, Laster and Powell. Voting opposed was Sidebottom. Motion carried.

Mayor Camp reported that John Davis with Air Evac had requested to be on the agenda tonight to ask the council to consider purchasing a membership for all city employees. There was discussion if the health insurance the city purchases for each employee would cover the cost of the flight. Clerk Brock will contact Anthem to see if the flight would be covered.

Clerk Brock reported the city is now accept credit and debit card payments in City Hall. Also, she is working on getting additional quotes for WiFi on Public Square and in the City-County Park.

There was no further discussion, therefore Mr. Gibson motioned to adjourn and seconded by Mr. Laster. Motion carried unanimously and meeting adjourned at approximately 8:15 PM.

Elkton Independence Day Celebration

Elkton, Kentucky invites you to celebrate Independence Day with activities planned for Sunday, July 3rd. Attendance to all events are free to the public.

The first event of the day will be a special presentation of "God and Country Celebration." The performance will start at 3:00 pm in the Welcome Center located in the Historic Todd County Courthouse located at One Public Square in Elkton.

The Elkton-Todd County Park will once again host the annual Independence Day Celebration and Fireworks Display at Todd County Central High School located at 806 South Main Street in Elkton. Bring a chair or blanket and get there early for a good seat!

B.R. Knuckles Insurance and Heritage Bank are once again graciously donating to the Elkton-Todd County Park to provide the fireworks display free to the public, which will begin at approximately 9:00 pm.

The Todd County Community Alliance is providing inflatable bouncers free for children to enjoy from 6 pm to 9 pm. TCCA is also providing free entertainment with gospel music beginning at 6 pm and "Tim Emery Band" will play beginning at about 7:00 pm.

Day of Service Project - Pitching in For a Better Park

Updated May 4, 2011: Over 300 volunteers pitched in for better park on the Day of Service and Kick Off Events. That was well over 900 hours of volunteer service!
The City of Elkton would like to thank the Church of Jesus Christ of Latter-Day Saints for choosing our project to support this year. We now have beautifully painted dugouts, picnic tables and concessions building, shiny like new fences, and colorful new landscaping around the park and the cleaned and stained gazebos. We especially want to thank everyone who volunteered to help make the City-County Park a more enjoyable place for our community.

Press Release: The City of Elkton and the Church of Jesus Christ of Latter-day Saints are partnering together for "Pitching in for a Better Park." Hundreds of people are expected to volunteer their time to make much needed improvements in the City-County Park located on South Main Street in Elkton.

The "Kick Off Event" will be held on Saturday, March 26th at 9:00 am at the park. There will be a short Kick Off Ceremony followed by rolling up our sleeves and starting to work! This day includes a lot of scraping and washing to help prepare for painting and repairs to be done on the "Pitching in for a Better Park" Day of Service Event, which will be held on Saturday, April 9th from 9 am to 3 pm.

Some of the projects include chain link fencing repairs; painting fences, dugouts and more; cleaning and staining walking trail bridges and gazebos; repairing swings; landscaping; repairing and painting picnic tables.

We would like to invite you, church groups and community groups to volunteer during either one of these events. We have a particular need for anyone skilled in the work to be performed mentioned above. And, any donations of paint, gloves, pressure washers, and more will be greatly appreciated. Elkton Bike Night Kicks Off April 7, 2011

Elkton Bike Night is set to kick off on Thursday, April 7, 2011 on Public Square in downtown Elkton, Kentucky. Each year, hundreds of motorcycles line Public Square every Thursday night. Even if you don't have a motorcycle, many people come to “the Square” just to visit and enjoy the live entertainment. On Thursday, April 7th, entertainment will be provided by the Five Star Band beginning about 5:30 PM.

The Todd County Community Alliance, a nonprofit membership organization established to promote Todd County, Kentucky, has already lined up live entertainment every Thursday night on Public Square from April 7th to September 29th. Other entertainment scheduled for later in the year includes additional performances by Five Star Band and the bands Midlife Crisis and Family Gospel and music by Clay Bilyeu and Sons of the South.

Food vendors, including Coy’s Barbeque, Backwoods Grilling and Bren’s Snack Shack are already planning to set up near Public Square on Bike Night. Local restaurants will also have Bike Night specials. According to Bike Night Committee Chairman, Robert Brown, “Other vendors, church groups, Relay for Life teams are also welcome and encouraged to set up. They just need to contact me to work out the details of setting up and I will help them find a location to set up.”

The Elkton Bike Night Committee is also scheduling a monthly “Saturday Ride” in Todd County. Each ride will start at 10:00 am on Public Square in Elkton and will continue through Todd County ending at a different location each month. The first “Saturday Ride” will be April 16th and will end at Shady Cliff Restaurant at Lake Malone. Other rides later in the year will end in Kirkmansville, Guthrie, Trenton and Clifty.

Annual Spring Cleanup

     The Annual Spring Cleanup is set to begin Monday, May 16th. The Cleanup is free curbside pick up of large garbage and junk items (not regular household garbage). It is open to residential customers only!

     Have items at the curb on those days and the City will pick them up and dispose of them. Items not to the curb by Wednesday, May 18th will not be picked up. Do not use any container you wish to keep.

     We CAN NOT pick up the following items: Any kind of batteries, freon, shingles, tires, tree toppings or limbs!

     Any senior citizens or disabled persons needing help moving items, please call City Hall at 265-9877 by Friday, May 13th.

The Elkton City Council met in special session on Tuesday, December 27, 2011 at 6:00 PM at Elkton City Hall with Mayor Nancy T. Camp presiding.

City Council members present: Doug Gibson; Eugene Jefferson; Jimmy Scott; David Powell; and, Cindy Sidebottom.

City Council members absent: Danny Laster.

Others present: City Clerk/Treasurer Laura Brock; and, Donald Settle.

Mayor Camp called the meeting to order at 6:00 PM.

AGENDA

1. Donald Settle – Elkton Die Casting Property

Mayor Camp welcomed Mr. Settle and turned the floor over to him to discuss the Elkton Die Casting building. Mr. Settle stated that he has found some electrical and metal contractors and suppliers that might be willing to donate to renovate the building. He has no intentions of making money on this project, but wants to offer classes to teach people in the community skills for entry level jobs in the area. He wants to volunteer his time to teach these classes and has other professionals that are willing to volunteer to teach as well. There was discussion that a common theme amongst local industries and the unemployed is there are not enough workers with the skills needed to find a job. There was also discussion that the foundry portion of the building may have some equipment that could be sold. And, the foundry could be used later for expansion or rented for storage. Clerk Brock stated that Rabold Environmental submitted a sealed bid back in October to abate the asbestos and clean the office portion of the building for $34,600. Mr. Rabold will have to agree the bid is still good. The office portion of the building was also tested for PCB and lead and all were found to be under action level. Mayor Camp called Mr. Rabold and he was put on speaker phone to discuss the matter with the council. Mr. Rabold confirmed that he would honor the bid submitted. He was also asked if he would provide “EPA certification that the building is cleaned.” He stated that what we would receive is a document stating the asbestos has been abated according to standards. He then stated that once they complete the abatement, there will be air monitoring reports done to make sure that any pollutants in the air don’t exceed safe levels as set forth by EPA and OSHA. The council thanked Mr. Rabold and the call was ended. Ms. Sidebottom motioned to accept Rabold Environmental’ s bid and move forward once the documents stating it has been cleaned according to standards are received. Motion seconded by Mr. Powell and carried unanimously. Mayor Camp stated once the building is cleaned, Mr. Kirkham will work with Mr. Rabold to determine the building is where we need it to be. Brock also stated Mr. Rabold has suggested installing a chain link fence around the switch grass area and making sure the foundry is secured. There were questions regarding how long the cleanup will take and how long Mr. Settle will take to get the building ready to use. Mr. Rabold was called back and he stated he could get started the first of the year and it would take about 14 days to complete, weather permitting. Mr. Settle stated that if Mr. Rabold was going to do a lot of the cleaning he would be ready to “hit the ground running” with renovations. Mr. Settle feels it will be a good community project and that many people will be willing to help. Clerk Brock also stated that Mr. Kirkham has questions about liability insurance that need to be cleared up before any work gets started renovating and using the building. Mr. Settle thanked the council and left the meeting.

There was no further discussion, therefore Mr. Powell motioned to adjourn and seconded by Mr. Scott. Motion carried unanimously and meeting adjourned at approximately 6:45 PM.

December 12 2011 Council Meeting Minutes

The Elkton City Council met in regular session on Monday, December 12, 2011 with Mayor Nancy T. Camp presiding.

City Council members present: Doug Gibson; Eugene Jefferson; Jimmy Scott; Danny Laster; and, Cindy Sidebottom.

City Council members absent: David Powell.

Others present: City Clerk/Treasurer Laura Brock; Utility Superintendent Terry Frogue; Police Chief Bruce Marklin; and, Catherine Darnell, Todd County Standard.

Mayor Camp called the meeting to order at 7:00 PM and led the pledge of allegiance. Mr. Danny Laster gave invocation.

After reviewing the minutes of the November 14, 2011 council meeting, bills payable and financial reports, Mrs. Sidebottom motioned to approve, seconded by Mr. Gibson and carried unanimously.

Clerk Brock read second reading of Ordinance 2011-13, “AN ORDINANCE ANNEXING 6.049 ACRES OF UNINCORPORATED TERRITORY INTO THE CITY OF ELKTON, AND ESTABLISHING ZONING FOR THE NEWLY ANNEXED AREA (DILLY TURNER, AND JOEY WELLS PROPERTY).” Mr. Scott motioned to adopt after second reading and seconded by Mr. Laster. Motion carried by unanimous show of hands.

Clerk Brock and Jimmy Scott updated the council on the progress of the City-County Park Improvement Project. Circle C Construction has completed much of the block work and has installed some of the plumbing in the concession/restroom building. After discussion, Clerk Brock presented Pay Request Number One to Circle C Construction in the amount of $16,848. Mr. Jefferson motioned to approve and seconded by Mr. Gibson. Motion carried unanimously.

Mayor Camp reported the new police vehicle that is in this year’s budget has been purchased and received. Therefore, the Police Department has requested the 2003 Ford Crown Victoria be declared surplus property. Chief Marklin reported the Todd County Jail would like to purchase the vehicle for $1,000. He has removed the lights from the vehicle so that we can use them in the future. After discussion, Mr. Scott motioned to declare the 2003 Ford Crown Victoria surplus property and seconded by Mr. Jefferson. Motion carried unanimously. Mr. Gibson motioned to sell the vehicle to the Todd County Jail for $1,000. Ms. Sidebottom seconded the motion and carried unanimously.

COUNCIL REPORTS

Mr. Gibson reported the paving in Glenwood and Elkton Cemeteries has been completed.

Mr. Jefferson called for a report from Chief Marklin, who reported department activity last month. He reported the department voted to leave the older Ford Explorer parked at the Police Department in case of bad weather.

Mr. Laster reported the water loss last month was 1.6%. Comparing the last 9 months to the same 9 months last year, finding the water loss has saved the water department about $72,000. Mr. Frogue reminded the council that the industry standard for water loss is 15%, so it is best not to expect the water loss to stay that low. Mr. Frogue also reported that Gary Larimore, Executive Director of Kentucky Rural Water Association, came down and met individually with Mr. Frogue and John Haley, Todd County Water District, to help find a solution to separating the two entities water systems fairly. Mr. Larimore then met with other KRWA staff and attorneys and came up with a proposal, which has been sent to the City and Water District for review. Mr. Frogue briefly explained the proposal and stated he does not know if the Water District has reviewed the proposal yet, but he will update the council on the progress of discussions.

Ms. Sidebottom stated the paving in the cemetery is complete, but there needs to be some additional work on the main entrance. There was also some discussion about one of the turns in Glenwood being repaired.

MAYOR’S REPORT

Mayor Camp asked Chief Marklin if there is a problem with synthetic drugs in our community, in particular items like herbal supplements, bath salts, etc. She stated that many cities are passing ordinances against selling them. It was discussed that it would be hard to pass laws selling these items because most of them have a legitimate use, but are being used improperly. The city may take a look at some ordinances other cities are passing.

Mayor Camp reported on some of the issues the Kentucky League of Cities will be taking up in the next legislative session. Some of those items are: 1) Relief for Hazardous Duty Retirement; 2) Pill mills; 3) Classifications of cities; 4) Restaurant tax reform; 5) More revenue for 911 services due to more people using cell phones instead of land lines; 6) Requiring banks to file deeds on abandoned properties; 7) Allowing counties to vote on Right to Work status.

Clerk Brock informed the council her assistant clerks have worked really hard to map all the cemetery lots in Glenwood Cemetery. They have visited almost all the lots in Glenwood, which is about 6,000 lots, to record all determents, birth dates and dates of death from the markers. There is still some work to be done in Elkton Cemetery.

There was no further discussion, therefore Mr. Laster motioned to adjourn and seconded by Mr. Gibson. Motion carried unanimously and meeting adjourned at approximately 7:30 PM.

Mayor Camp welcomed Mike Baker and Eston Glover to the meeting. Mike Baker explained the creation of the Foundation and that they meet almost monthly. At each meeting a financial statement and minutes of meetings are presented. Mr. Baker also gives an update verbally and in writing of activity each month. Mr. Baker explained funding support to the Foundation, including the county contribution, $25,000; Guthrie, $15,000; Trenton, $250; TVA, $20,000 (with additional grant support of about $35,000); and Pennyrile Electric, $5,000. Mr. Baker stated that in the last few years, Flexcon and Refine Tile have made significant investments in Elkton and employ about 125-135 employees. Also, both of these companies expect expansions in the near future. There have been four other announcements in the county since Hemlock located in Clarksville. Also, Martin Industries in Elkton has expanded by purchasing an additional six acres. Council members suggested they need more updates from the Foundation as to what is going on in Elkton and asked if there been any visits to Elkton. Mr. Baker stated that Mayor Camp is a member of the Foundation, but if any council members wanted to be on the Foundation or attend the meetings, it could possibly be worked out. Mr. Baker stated there have been no visits to Elkton. There was concern that all the visits and recommendations for locating in Todd County are going to south Todd County and no one is being shown locations in Elkton. Mr. Baker stated that south Todd is in a great location being close to I-24, two railroad tracks and being close to a large city. After discussion, Mr. Baker thanked the council and left the meeting.

Clerk Brock read second reading of Summary Ordinance 2011-10, “AN ORDINANCE AMENDING SECTIONS 92.01, AND 92.04 OF CHAPTER 92 OF THE CODE OF ORDINANCES FOR THE CITY OF ELKTON, KENTUCKY, PERTAINING TO NUISANCES.” Ms. Sidebottom motioned to adopt after second reading and seconded by Mr. Powell. Motion carried unanimously by show of hands.

Mayor Camp reported she received another request from the Todd County Industrial Foundation for the annual contribution of $10,000, which is in the city’s budget for this year. Mr. Powell stated there are still concerns about what the Industrial Foundation is doing for Elkton. They have also promised to attend city council meetings to keep the council updated on what is going on in the county and in Elkton, but they have yet to attend. Mayor Camp also stated that city employees finally went to take down the damaged Industrial Foundation sign just outside of Elkton. Mr. Powell suggested contributing $5,000 for now until they show the council what they are doing for Elkton. Mayor Camp stated she is supposed to meet with some of the Industrial Foundation members on September 29th. Several council members suggested holding off on any contribution until after the Mayor meets with them or until they attend a council meeting. There was no action taken.

Clerk Brock read second reading of Ordinance 2011-11, “AN ORDINANCE FIXING THE AD VALOREM TAX RATE UPON THE ASSESSED VALUATION OF REAL ESTATE, PERSONAL PROPERTY, MOTOR VEHICLES AND WATERCRAFT WITHIN THE CITY LIMITS OF ELKTON, KENTUCKY, FOR THE YEAR 2011.” There was considerable discussion about not increasing the real property tax rate from $.248 to $.250. The amount of money gained by the increase would be about $1,100. After more discussion, Clerk Brock stated that the council has amended the budget to add expenditures of about $64,400 since July and that we will probably also go over budget in utilities due to electric bill increases and fuel bill increases for the police department. There was no motion to adopt Ordinance 2011-11, therefore the ordinance failed. Mr. Powell motioned to adopt the same real property tax rate as last year for 2011. Motion seconded by Mr. Laster and carried unanimously. There will need to be two special meetings to read the ordinance adopting the tax rate. The dates for the special meetings were set for Monday, September 26th at 6:00 PM and Tuesday, September 27th at 4:45 PM.

Mayor Camp reported the city received bids for “Asphalt Surfacing” on Friday, September 16, 2011 at 3:00 PM. This was for surfacing the streets in Elkton Cemetery, Glenwood Cemetery and widening two small portions of Goeble Avenue. One bid was received from Scotty’s Contracting and Stone in the amount of $24,468.00. Mr. Laster motioned to approve the bid from Scotty’s and seconded by Ms. Sidebottom. Motion carried unanimously.

Mayor Camp asked Terry Frogue to update the council on Riverbend Subdivision. Mr. Frogue reported that Mr. Overholt has not followed through on his portion of the Agreement entered into back in 2009, mostly involving completion of the retention basin in the subdivision once the city extended sewer to his property. Mr. Frogue stated the city has completed all of their responsibilities of the drainage plan and if the retention basin is not completed properly, what the city has done will be washed out. The Planning Commission also required Mr. Overholt to build up through the base layer of asphalt of the street to the first six lots and provide the city a letter of credit for the top layer of asphalt before he was allowed to build the first six houses. Mr. Overholt has already built the foundation to the first house without a building permit and he has not given the city a letter of credit. There was considerable discussion of how to handle these issues, either through legal action by the city, the Code Enforcement Board or through the Planning Commission. Mr. Powell motioned to handle this issue through the Planning Commission first and then through the council if necessary. Mr. Scott seconded the motion and carried unanimously.

The Elkton City Council met in regular session on Monday, September 12, 2011 with Mayor Nancy T. Camp presiding.

City Council members present: Eugene Jefferson; Jimmy Scott; Danny Laster; David Powell; and, Cindy Sidebottom.

City Council members absent: Doug Gibson.

Others present: City Clerk/Treasurer Laura Brock; Utility Superintendent Terry Frogue; City Attorney John P. Kirkham; Police Chief Bruce Marklin; Catherine Darnell, Todd County Standard; and, Marie Fainter, WHOP Radio.

Mayor Camp called the meeting to order at 7:00 PM and led the pledge of allegiance. Mr. David Powell gave invocation.

Mayor Camp announced Mr. Gibson is still recovering from surgery and is not feeling well enough to attend.

After reviewing the minutes of the August 8, 2011 council meeting, bills payable and financial reports, Mr. Jefferson motioned to approve, seconded by Mr. Laster and carried unanimously.

Clerk Brock read second reading of Ordinance 2011-9, “AN ORDINANCE AMENDING SECTIONS 35.095, 35.103, 35.104, 35.105, AND 35.108 OF CHAPTER 35 OF THE CODE OF ORDINANCES OF THE CITY OF ELKTON PERTAINING TO THE CODE ENFORCEMENT BOARD.” Mr. Powell motioned to adopt after second reading and seconded by Mr. Laster. Motion carried unanimously by show of hands.

Clerk Brock stated that Mr. Kirkham has prepared a summary of Ordinance 2011-10 amending the Nuisance Ordinance if the council wishes to read and publish the summary instead of the full ordinance. After discussion, Mr. Jefferson motioned to read and publish the summary of Ordinance 2011-10. Mr. Scott seconded the motion and carried unanimously by show of hands. Clerk Brock presented calculations for the 2011 ad valorem property tax rates. The compensating rate for 2011 is $.240 per $100 assessment for real property and $.361 per $100 assessment for personal property. The compensating rate would generate approximately $1,604 over last year. Rate II for 2011 is $.250 per $100 assessment for real property and $.361 per $100 assessment for personal property and would generate approximately $7,272 over last year. The 4% rate, which requires two public notices and a public hearing, is $.260 per $100 assessment for real property and $.376 per $100 assessment for personal property. The 4% rate would generate approximately $13,910 over last year. Last year’s rates were $.248 per $100 assessment for real property and $.309 per $100 assessment for personal property. If the real property tax rate is set as the same rate as last year and the personal rate at the compensating rate, it would generate about $6,139 over last year. Clerk Brock recommended setting the rate at Rate II, which would be a $.002 increase over last year. There was discussion about what the increase would mean to citizens. Clerk Brock figured that a $.002 increase on $100,000 of assessment would be a $2.00 increase for the year. After discussion, Mr. Jefferson motioned to set the 2011 rates at Rate II. Motion seconded by Mr. Scott. Voting in favor of the motion were Jefferson, Scott and Sidebottom. Voting opposed were Laster and Powell. Motion carried.

Mayor Camp stated that there will need to be a special council meeting on Tuesday, September 20, 2011 for second reading of the tax rate ordinance and other items. After discussion, the meeting will be held at 4:30 PM.

Resolution 2011-3, “A RESOLUTION SUPPORTING AT&T'S ACQUISITION OF T-MOBILE USA” was presented to the council. After discussion, Mr. Jefferson motioned to adopt and seconded by Mr. Laster. Motion carried unanimously by show of hands.

Resolution 2011-4, “A RESOLUTION OF THE CITY OF ELKTON, KENTUCKY REGARDING 2011 KENTUCKY COMMUNITY DEVELOMENT BLOCK GRANT” was presented to the council. After discussion, Mr. Laster motioned to adopt and seconded by Ms. Sidebottom. Motion carried unanimously by show of hands.

Air Evac would like to offer a $10.00 discount on memberships to new customers from Elkton. They would like to send out this notice in the utility bills. After discussion, Mr. Laster motioned to allow Air Evac to make this offer to the citizens of Elkton. Motion seconded by Mr. Scott and carried unanimously.

Mayor Camp has received a request from Pennyrile RC and D for a contribution of $300. In the past, the city has contributed $200 annually for their continued support of Elkton projects. There was discussion of what projects they have helped us with in the past. After discussion, Mr. Jefferson motioned to contribute $300 to Pennyrile RC and D. Motion seconded by Mr. Powell and carried unanimously.

Todd County Industrial Foundation has sent a second request for our annual contribution of $10,000. Clerk Brock confirmed the funds are in the city’s budget. There was discussion of how the Industrial Foundation is promoting Elkton and that there doesn’t seem to be any efforts to do so. Mr. Frogue reported he took down the Industrial Foundation sign that was falling down and it has not been repaired or replaced by the Foundation. Mr. Scott motioned to contribute $10,000 to the Foundation. The motion died for lack of a second.

Mayor Camp reported the city has received a full report from Reibold Environmental for the inspection and testing inside and outside of the Die Casting property. Clerk Brock is preparing a Request for Bids to advertise cleaning up the building based on the report. Mayor Camp stated the city needs to put a fence around the switch grass area.

Mayor Camp reported Ricchutie Enterprises will perform the annual leaf pickup for the same price as last year, $19,950. Mr. Powell motioned to contract with Ricchutie Enterprises for the leaf pickup. Motion seconded by Mr. Jefferson and carried unanimously.

Elkton Bank and Trust Company has offered to fix the clock in the historic courthouse. The Bank will spend approximately $20,000 to make the necessary repairs. They will also keep the clock under a maintenance contract. The bank has also gotten a bid to clean and paint the clock tower at a cost of $18,970. The bank is willing to contribute $5,000 towards painting the tower. If the city wants to paint the tower, we would need to contribute the remaining balance of $13,970. There is approximately $3,768 remaining in the “Start the Clock” fund that could be used for this effort. There is also money in the Building and Maintenance Fund that can be used. Mayor Camp stated this is one of the best gifts the city has ever received and we should all be thankful to President Gary Traughber and the board. Ms. Sidebottom motioned to paint the clock tower and seconded by Mr. Laster. Motion carried unanimously.

Mayor Camp presented a bid from David Smith to build new doors and thresholds for the historic courthouse. The thresholds are rotted and the doors need replacing. Three new doors would be made of cypress and would be replicas of the original doors at a cost of $5,875. There would be an extra cost for purchasing restoration hardware for the doors. After discussion, Mr. Laster motioned to approve David Smith building new doors for the courthouse. Motion seconded by Ms. Sidebottom and carried unanimously.

Clerk Brock reported that the WiFi on the Square is not working because the equipment was struck by lightning or power surges that burned out some of the antennas and routers. This has happened several times since we installed the equipment. Therefore, Clerk Brock got a quote from Cornerstone Information Systems, who recommends replacing the equipment and grounding each antenna to protect it better from lightning at a cost of about $9,000. This equipment will also better handle the large amount of traffic on the system. They still cannot guarantee 100% that the equipment would not be damaged in the future. After discussion, Clerk Brock will look into insurance coverage and the cost of equipment that would expand the coverage area.

Mayor Camp asked the council if they have thought any more about the request from Mike McGhee to rename the City-County Park the “Moore Family Park” in honor of Wilmon Moore. There was discussion that another family also donated a portion of the property for the park. Also, when the park was built, several people donated a lot of labor to help build the ball fields, etc. So, there was considerable concern that naming the park after just one family would not be fair to the others that contributed. Several council members stated they would be in favor of putting a sign in the park to commemorate the Moore family’s contribution. There was discussion that the fiscal court has not made a decision on changing the name of the park yet. Mr. Jefferson motioned that the name of the park not be changed and the city should be in favor of putting up a sign in recognition of the Moore family. Motion seconded by Mr. Laster and carried unanimously.

COUNCIL REPORTS

Mr. Jefferson called for a report from Police Chief Marklin, who reported on Police Department activity in August. He also reported there was a major gas line break last week and then the next day a gas leak in the high school. He reported all emergency personnel worked well together and there were no problems.

Mr. Scott reported fall soccer and adult softball have started in the park.

Mr. Laster stated there were no water loss calculations this month to report. Mr. Frogue reported that the department has been testing the fire hydrants for the Fire Department and opening valves, so that would cause some water loss this month. Mr. Frogue also reported the department is replacing a portion of the sidewalk on South Main Street but the current property owner needs to take down an iron fence before the new sidewalk can be formed and poured.

Mr. Powell reported the fire department had one fire run this month, several false alarms and were also called out during the two gas leaks.

MAYOR’S REPORT

Mayor Camp requested the council set the Halloween Trick-or-Treat times in Elkton. Ms. Sidebottom motioned to hold trick-or-treat on Monday, October 31st from 5 PM to 8 PM. Motion seconded by Mr. Scott and carried unanimously.

Clerk Brock reported she is still working with Alliance and the merchant account company to set up our system to accept credit and debit card payments. Alliance is working on a software licensing issue and once that is settled in the next few weeks the city should be able to accept credit and debit card payments.

Mr. Scott mentioned that the Recreation Commission is considering asking the magistrates and council members to volunteer working in the concession stand next year at the park.

Mayor Camp stated she would like to have a business and industry appreciation dinner, possibly with the Todd County Community Alliance, in the near future.

Clerk Brock reported she has received the first construction pay request for the West Jefferson Davis and Highway 68/80 Sewer Extension Project. The project is approximately 77% complete according the payment estimate. The request includes payment to McGhee Engineering for $8,550.00 and Garrison Construction Co. for $48,854.25 for a total of $57,404.25. After brief discussion, Mr. Jefferson motioned to approve the request and seconded by Mr. Powell. Motion carried unanimously.

Clerk Brock read second reading of Ordinance 2011-6, “AN ORDINANCE AMENDING THE ANNUAL BUDGET FOR THE CITY OF ELKTON, KENTUCKY, FOR THE FISCAL YEAR JULY 1, 2010 THROUGH JUNE 30, 2011.” Mr. Gibson motioned to adopt after second reading and seconded by Mr. Jefferson. Motion carried unanimously by show of hands.

Clerk Brock read second reading of Ordinance 2011-7, “AN ORDINANCE RELATING TO THE ANNUAL BUDGET AND APPROPRIATIONS FOR THE CITY OF ELKTON, KENTUCKY, FOR THE FISCAL YEAR JULY 1, 2011 THROUGH JUNE 30, 2012.” Mr. Jefferson motioned to adopt after second reading and seconded by Mr. Scott. Motion carried unanimously by show of hands.

Mayor Camp recommended that the city hire one additional employee to work with the utility department. There is a lot of work that needs to be done and an extra employee will help the department get caught up. Mayor Camp has an application on file for someone with good skills and experience running heavy equipment that she would like to hire at $14.00 per hour. The council questioned if this was higher than the normal starting wage and Mayor Camp said it was due, but because of his experience. Clerk Brock stated the total cost to hire a new employee was about $49,000 at this rate of pay. After discussion, Mr. Gibson motioned to hire the new employee as recommended and seconded by Mr. Powell. Motion carried unanimously. Clerk Brock stated that this is a new position that is not in next year’s budget, therefore the budget will need to be amended. After discussion, Mr. Laster motioned to amend the FY2012 budget to include the new employee and take half the cost out of the general fund and half the cost out of the water fund. Mr. Gibson seconded the motion and carried unanimously.

Clerk Brock read first reading of Ordinance 2011-8, “ORDINANCE ADOPTING COMPENSATION PLAN AND PAY SCALE.” Clerk Brock stated this is amending the pay scale to include a 2% cost of living increase. Mr. Jefferson motioned to approve after first reading and seconded by Mr. Laster. Motion carried unanimously.

Clerk Brock read Municipal Order 2011-2, “MUNICIPAL ORDER AMENDING THE PERSONNEL POLICIES AND PROCEDURE.” Clerk Brock stated this amendment will change the date for new employee eligibility for health and dental insurance to the first day of the month following 30 days of employment. Mr. Laster motioned to adopt Municipal Order 2011-2 and seconded by Mr. Scott. Motion carried unanimously.

Resolution 2011-2, “RESOLUTION OF THE CITY OF ELKTON, KENTUCKY APPROVING AND AUTHORIZING AN ASSISTANCE AGREEMENT BETWEEN THE CITY OF ELKTON, KENTUCKY AND THE KENTUCKY INFRASTRUCTURE AUTHORITY” was presented to the council. Mr. Powell motioned to adopt and seconded by Mr. Scott. Motion carried unanimously.

Mr. Frogue reported that ATMOS Energy will charge the city $4.33 per foot to install the gas line in the same trench as the water line extension on Commerce Street. Mr. Frogue originally reported an estimated cost of $4.00 per foot for about 1,000 feet of line, which the council approved at a past meeting. Also, Mr. Dilly Turner stated he would annex approximately 5 lots on B. White Road, but only if the city would extend the gas line an additional 875 feet to his property. The total cost for this project is approximately $6,819.75 with the utility department providing all the equipment and labor while they are installing the water line. The only additional cost would be if we hit rock at which time we would need to contract with someone to do the trenching. Mr. Scott questioned why the city is installing the gas line. Mr. Frogue stated that ATMOS energy currently does not extend lines for customers. He also stated it will help make the area more attractive to growth and because Mr. Turner would like to annex five building lots if the city runs this line. Mr. Frogue also reminded the council the city would receive a rebate of about $866 from ATMOS for each customer that connects to this line since we paid for installation. After discussion, Mr. Gibson motioned to run the gas line with the water line. Motion seconded by Mrs. Sidebottom. Voting in favor of the motion were Gibson, Jefferson, Laster, Powell, and Sidebottom. Mr. Scott abstained. Motion carried.

Mr. Frogue reported the city owns approximately 2,000 feet of 6” ductile pipe that was left over from the sewer plant upgrade project. At first he thought we might use it for the Commerce Street water line, however it is not the best type of pipe to use and we could probably sell the pipe and purchase less expensive PVC, which will last longer than ductile. After discussion, Mr. Laster motioned to declare the ductile pipe surplus property and sell it. Motion seconded by Mr. Jefferson and carried unanimously.

Also regarding surplus property, Mr. Frogue reported sealed bids were received on June 10, 2011 for the sale of surplus old radio read water meters, handheld meter readers with wands and two large scrap metal items. Regarding the water meters, Josh Costello withdrew his bid of $6.29 per meter leaving the high bidder as Adams Surplus at $5.25 each. Mr. Jefferson motioned to accept the bid of Adams Surplus, seconded by Mr. Powell and carried unanimously. The city received two bids of $200.00 for the large scrap metal items. Mr. Frogue suggested rejecting these bids because the city will be hiring a crane in the next few weeks and we could load these items up and sell them ourselves and probably make more money. Mrs. Sidebottom motioned to reject the two bids and seconded by Mr. Scott. Motion carried unanimously. Adams Surplus was the only bidder for the two handheld meter readers and wands at $20.00 each. Mr. Frogue requested this bid be rejected because they are worth more. Mr. Laster motioned to reject the bid for the meter readers and wands and seconded by Mr. Gibson. Motion carried unanimously.

Mayor Camp reported she received a letter of resignation from Jeff Leavell from the Recreation Commission. Mr. Jefferson motioned to accept the resignation and seconded by Mr. Scott. Motion carried unanimously.

Mayor Camp recommended the appointment of Bridgette Robinson to the Recreation Commission. Mr. Scott motioned to accept the recommendation and seconded by Mr. Powell. Motion carried unanimously.

Mayor Camp recommended the appointment of Jeff McKinney to the Recreation Commission. Mr. Scott motioned to approve and seconded by Mr. Laster. Motion carried unanimously.

Mr. Scott reported the city received sealed bids for the renovation of the concession/restroom building at the park as a part of the Park Improvement Project on June 10, 2011. The following bids were received:

1. Haley Construction $56,500.00
2. NAI Construction  $69,653.00
3. Circle C Construction $38,303.33
4. Carter Douglas Company $47,000.00

Mr. Scott stated the bids varied quite a bit and he feels there may be too many changes that will need to be made to make the bids fair. He and Judge Greenfield met to review the bid specs and bids received. After discussion, Mr. Scott motioned to reject all the bids and wait and re-bid the project in the fall. Motion seconded by Mr. Laster and carried unanimously.

Mayor Camp reported she received a letter of resignation from Bill Gardner of the Planning Commission. Mr. Scott motioned to accept the resignation and seconded by Mr. Powell. Motion carried unanimously.

Mayor Camp reported that she and other city officials met with Justice Center Project officials, Community House Board members and utility companies to discuss burying utility lines and installing new sidewalks from Public Square down to North Streets Avenue beside the Community House. The estimate for just burying utility lines was about $750,000. Funding for this project is being discussed but may be too expensive.

Mayor Camp reported that Karen Martinez of American General has requested meeting with city employees to discuss insurance programs she has available. Clerk Brock stated we have requests from insurance companies all the time to meet with employees and it is hard to accommodate everyone. She suggested having an “insurance fair day” where all the companies come one day per year to discuss insurance plans with employees. After discussion, Mr. Laster motioned to allow American General to meet with employees on their own time. Motion seconded by Mr. Powell and carried unanimously.

Clerk Brock informed the council the Green River Academy is holding another “Supper in the Cemetery” event in Glenwood Cemetery on Saturday, June 25th.

The Elkton City Council met in special session on Tuesday, May 24, 2011 with Mayor Nancy T. Camp presiding.

City Council members present: Eugene Jefferson; Jimmy Scott; Danny Laster; David Powell; Cindy Sidebottom; and, Doug Gibson.

Others present: City Clerk/Treasurer Laura Brock; Utility Superintendent Terry Frogue; and, Elizabeth Johnson, Todd County Standard.

Mayor Camp called the meeting to order at 5:30 PM and reminded everyone that only items on the agenda could be discussed in special session.

Terry Frogue reported the Todd County Water District does not want to sell the city the water line on B. White Road. There is already some planned construction in the city limits on B. White Road and some areas that will be annexed in the city limits in the near future. So, in order to serve these customers water, we would need to run our own water line. Also, there has been discussion about the city also running the gas line in the same ditch at the same time to help save on the cost. Mr. Frogue stated the city could perform the labor to run the lines and we might be able to use some pipe that is already on hand for the water line. Depending on how much rock there is, we might need to contract out some of the digging. Mr. Frogue thinks the water line extension might cost about $10,000. The gas line would cost approximately $4.00 per foot and the city would be reimbursed for the cost as new customers connect to the line. The lines would extend down Commerce Street and then down B. White Road to serve the planned construction areas in the city limits. After discussion, Mr. Gibson motioned to run the water and gas lines. Motion seconded by Mr. Powell. Voting in favor of the motion were Gibson, Jefferson, Laster, Powell and Sidebottom. Voting opposed was Scott. Motion carried.

Mayor Camp reported that several large trees in Glenwood Cemetery were about to fall last week. Therefore, Sears’ Tree Removal rented a large crane and took down the three trees, grinded the stumps and limbed up several other trees. This work had to be done quickly in order to prevent damage to the cemetery and headstones. Mayor Camp asked for approval to pay the bill in the amount of $11,750. Mr. Jefferson motioned to approve and seconded by Mr. Scott. Motion carried unanimously.

Clerk Brock read second reading on Ordinance 2011-5, “AN ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES OF THE CITY OF ELKTON, KENTUCKY.” Mr. Powell motioned to adopt after second reading and seconded by Mr. Laster. Motion carried unanimously by show of hands.

Clerk Brock discussed the proposed budget amendment ordinance for fiscal year ending June 30, 2011. Most of the adjustments are for unanticipated income and expenditures the council voted on throughout the year. Clerk Brock read first reading of Ordinance 2011-6, “AN ORDINANCE AMENDING THE ANNUAL BUDGET FOR THE CITY OF ELKTON, KENTUCKY, FOR THE FISCAL YEAR JULY 1, 2010 THROUGH JUNE 30, 2011.” Ms. Sidebottom motioned to approve after first reading and seconded by Mr. Jefferson. Motion carried unanimously by show of hands.

Mayor Camp presented the budget message and proposal for fiscal year ending June 30, 2012. Clerk Brock discussed the budget summaries of the general fund, water department and sewer department. After discussion, Clerk Brock read first reading of Ordinance 2011-7, “AN ORDINANCE RELATING TO THE ANNUAL BUDGET AND APPROPRIATIONS FOR THE CITY OF ELKTON, KENTUCKY, FOR THE FISCAL YEAR JULY 1, 2011 THROUGH JUNE 30, 2012.” Mr. Laster motioned to approve after first reading and seconded by Mr. Powell. Motion carried unanimously by show of hands.

The Elkton City Council met in regular session on Monday, May 9, 2011 with Mayor Nancy T. Camp presiding.

City Council members present: Eugene Jefferson; Jimmy Scott; Danny Laster; David Powell; Cindy Sidebottom; and, Doug Gibson.

Others present: City Clerk/Treasurer Laura Brock; Utility Superintendent Terry Frogue; Police Chief Bruce Marklin; Sandra Johnson; Robbie McLellan and Jen Harris, Todd County Health Department; and, Jenni Osborne, Todd County Standard.

Mayor Camp called the meeting to order at 7:00 PM and led the Pledge of Allegiance. Mr. Jimmy Scott gave invocation. Mayor Camp welcomed and introduced all of the guests in attendance.

After reviewing the minutes of the April 11, 2011 regular council meeting, bills payable and financial reports, Mr. Jefferson motioned to approve. Motion seconded by Mr. Gibson and carried unanimously.

Mayor Camp introduced Jen Harris and Robbie McLellan with the Todd County Health Department to discuss the permit requirements for food vendors setting up at Bike Night and other events. Mr. McLellan passed out information on the permit requirements for temporary vendors and the regulations they are required to follow. If the vendor is temporary and not in a permanent structure, the permit is good for 14 consecutive days at one location and they can not return to that location until 30 days after the permit expires. This is why the food vendors that set up during Bike Night have to move locations after 14 days. Some temporary vendors have sinks and proper hand washing facilities to allow a statewide annual permit, however they still have to follow the 14 day rule. There was much discussion about interpretation of the regulations. Mrs. Harris stated they have contacted that State Food Services Branch to ask for clarification and they affirmed that Mr. McLellan is enforcing the rules correctly, but she invited anyone to contact the state to discuss the rules. After discussion, the Mayor and council thanked Mrs. Harris and Mr. McLellan for attending the meeting.

Mayor Camp requested the council amend the agenda to allow Mrs. Sandra Johnson to go next on the agenda. Mr. Jefferson motioned to approve and seconded by Mr. Gibson. Motion carried unanimously. Mrs. Johnson sent a letter to each council member and the Mayor to complain about a neighbor who put up a security light that is close to her property line and shines through a window in her house. She expressed concern that neither the city nor Pennyrile Electric has any regulations regarding shining light on other people’s property. After much discussion, Mayor Camp stated she will ask the Planning Commission to consider this topic and discuss possible regulations. Mr. Powell stated that he will talk to the neighbor.

Clerk Brock read first reading on Ordinance 2011-5, “AN ORDINANCE ENACTING AND ADOPTING A SUPPLEMENT TO THE CODE OF ORDINANCES OF THE CITY OF ELKTON, KENTUCKY.” Mr. Powell motioned to accept after first reading and seconded by Mrs. Sidebottom. Motion carried unanimously by show of hands.

Clerk Brock presented a proposal from Thurman Campbell Group to perform the audit of the financial statements ending June 30, 2011 and preparation of the City Uniform Financial Information Report for the amount of $16,500.00. This is the same amount as last year. Mr. Gibson motioned to accept the proposal and seconded by Mrs. Sidebottom. Motion carried unanimously.

Mayor Camp reported that sealed bids were received for the Commerce Street Sewer Extension Project on Thursday, May 5, 2011 at 11:00 am at City Hall. Bids received were as follows:

Clerk Brock stated Chris Wilcutt of McGhee Engineering sent the city a letter stating he has reviewed the bids and checked all references for the low bidder, WHF, Inc., and recommends the city accept their bid of $38,231.00. Clerk Brock stated the council can authorize the Mayor to award the contract, however she recommends the contract be awarded contingent upon receiving the consent to annexation from Joey Wells. Mr. Scott motioned to award the contract to WHF, Inc. contingent upon receipt of consent to annexation from Joey Wells. Motion seconded by Mr. Laster and carried unanimously.

Mayor Camp reported that Rabold Environmental has looked at the Elkton Die Casting building and has proposed the city test for PCBs, asbestos, metals and lead paint in the office portion of the building that would be used for the adult training center. The cost to perform and analyze the tests would be $5,985.00. Then, after the testing is completed, we will know how much contamination is involved, if any, with cleanup of that portion of the building. The large foundry portion of the building is not included and it is proposed to secure and seal that portion of the building. Clerk Brock has contacted Amanda Lefevre with the Energy and Environment Cabinet and would like to discuss the cleanup process with her prior to having anyone cleanup or test the building.

Mayor Camp and Clerk Brock updated the council on the South Streets Avenue Sidewalk and Drainage Project. Both met with the engineers designing the project and a draft of the plans is ready to be sent to the state.

COUNCIL REPORTS

Mr. Jefferson called for a report from Police Chief Marklin. Chief Marklin reported that a new officer (Will Meyers) was hired last week. Chief Marklin reported department activity last month.
Mr. Scott reported activity in the City-County Park.

Mr. Laster reported that the water loss in the city was still down to about 10% last month. Mr. Frogue reported the department repaired several more small leaks. Also, with the recent rains and flooding, there have been several hours of overtime at the sewer plant and because of sewer backing up.

Mrs. Sidebottom reported that the city will need to do some paving in the cemetery soon. She and Clerk Brock will discuss putting some paving in next year’s budget.

MAYOR’S REPORT

Mayor Camp stated that Karen Martinez would like to meet with the Mayor and several council members to discuss insurance programs for city employees.

Mayor Camp reported the regular June council meeting conflicts with the Annual PADD Dinner Meeting. Mayor Camp requested the regular meeting be cancelled and a special meeting scheduled for Tuesday, June 14th at 7:00 pm. Mr. Laster motioned to approve the request and seconded by Mr. Scott. Motion carried unanimously.

Mayor Camp reported receiving a lot of compliments on the Eggstravaganza and Carnival that was held in April. It had been 23 years since the last carnival was held in Elkton. Many of the local businesses stated their business was up that weekend with everyone in town.

Mayor Camp reported the Welcome Center is going to host the “Cruise In” at the Elkton Die Casting property instead of on the Square.

On May 16th, Mayor Camp and Raymond Williams will be attending training on rules to follow when checking out the inmates for work release.

Mayor Camp reminded everyone the annual Spring Clean Up will start on Monday, May 16th and continue through Thursday, May 19th.

Police Chief Marklin reported the department has received a Highway Safety Grant to pay for officer overtime to perform safety check points in the city.

The Elkton City Council met in regular session on Monday, April 11, 2011 with Mayor Nancy T. Camp presiding.

Others present: City Attorney John P. Kirkham; City Clerk/Treasurer Laura Brock; Utility Superintendent Terry Frogue; Police Chief Bruce Marklin; Debra Sale, Todd County Welcome Center; Dr. Ted Beam, Petrie Memorial United Methodist Church; Cheryl Dossett, Pam Morrison, Llewanne Bass, and Larry Frogue, Church of Jesus Christ of Latter-day Saints; and, Catherine Darnell, Todd County Standard.

Mayor Camp called the meeting to order at 7:00 PM and led the Pledge of Allegiance. Mr. Danny Laster gave invocation.

Mayor Camp welcomed and introduced all of the guests and requested the council amend the agenda to allow the guests from the Church of Jesus Christ of Latter-day Saints to go first on the agenda. Mr. Scott motioned to approve and seconded by Mr. Laster. Motion carried unanimously.

Llewanne Bass stated that 281 people volunteered in the City-County Park on Saturday, April 9, 2011 for the Day of Service Project, “Pitching in for a Better Park.” In all, over 900 hours of work was donated by the volunteers. Ms. Bass thanked the mayor and council and all of those involved with planning the event and presented trophies to Mr. Danny Laster, Mr. Jimmy Scott and Laura Brock and a plaque to Mayor Nancy Camp. Mr. Larry Frogue also thanked everyone who helped organize the event on behalf of the church. All agreed that the City-County Park means a lot to the community and that the improvements made will allow everyone in Todd County to enjoy the park even more. Mr. Scott stated that on behalf of the city, we need to thank the Church and everyone who volunteered for helping with the park improvement project. Mayor Camp agreed and thanked everyone involved. (The church members left the meeting at this time.)

Mayor Camp introduced Debra Sale to update the council on the upcoming Eggstravaganza and Carnival from April 28th through April 30th. Mrs. Sale thanked the council for allowing the event to be held on the Elkton Die Casting property. The carnival rides and games will be held Thursday and Friday evening and all day Saturday. There will be a “Spring Scramble Dance” on Friday night with a free concert. There will be vendors and yard sale booths on all three days. Saturday, the Kentucky Poultry Federation is donating the use of eight cooking booths to give away free omelet samples and to give cooking demonstrations. There will be picnic areas with acoustic music being played by local musicians. Mrs. Sale stated if anyone has any questions to please contact her at the Welcome Center.

After reviewing the minutes of the March 14, 2011 regular council meeting, minutes of the March 23, 2011 special council meeting, bills payable and financial reports, Mr. Scott motioned to approve. Motion seconded by Mr. Powell and carried unanimously.

Mayor Camp received a request for a contribution for the American Red Cross. There is no set amount requested, however they suggested a $1,000 donation. The Red Cross will help serve Elkton even if we don’t contribute. Chief Marklin and Mayor Camp stated the Red Cross is working to start a chapter in Todd County and help set up emergency plans. The council took no action at this time.

Mayor Camp reported that the health department has informed the Elkton Bike Night food vendors that regulations require them to not stay in one location for more than 14 days or a different type permit that requires restroom facilities and hand washing stations would be required. The health inspector suggested the city close down three alleys on the Square and allow the vendors to rotate around these locations every two weeks. It was the consensus that the council would like for the inspector to attend the next council meeting to explain the rules more clearly. There was much discussion regarding traffic if vendors set up on the Square. After discussion, Mr. Gibson motioned to start closing three alleys on the Square for vendors beginning April 21st and notify the vendors this week that they will be able to set up in the alleys the following week. Motion seconded by Mr. Jefferson and carried unanimously.

Clerk Brock read second reading of Ordinance 2011-2, “ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ELKTON, KENTUCKY DEALING WITH THE ELKTON-TODD COUNTY RECREATION COMMISSION.” Mrs. Sidebottom motioned to adopt after second reading and seconded by Mr. Scott. Motion carried unanimously by show of hands.

Clerk Brock read second reading of Ordinance 2011-3, “AN ORDINANCE REPEALING §35.015 OF THE CODE ORDINANCES OF THE CITY OF ELKTON, WHICH ESTABLISHED A PARKS AND RECREATION ADMINISTRATION COUNCIL.” Mr. Jefferson motioned to adopt after second reading and seconded by Mr. Laster. Motion carried unanimously by show of hands.

Clerk Brock read second reading of Ordinance 2011-4, “AN ORDINANCE AMENDING SECTION 52.04(A) OF THE CODE OF ORDINANCES OF THE CITY OF ELKTON ADJUSTING AND MODIFYING USER RATES FOR WASTEWATER SERVICES IN THE CITY OF ELKTON.” Mr. Gibson motioned to adopt after second reading and seconded by Mr. Powell. Motion carried unanimously by show of hands.

Municipal Order 2011-2, “A MUNICIPAL ORDER AUTHORIZING THE DISPOSITION OF REAL PROPERTY PURSUANT TO KRS 82.083” was presented to the council. This order declares North Weathers Lane surplus property and authorizes the transfer of the property to the Todd County Fiscal Court. After discussion, Mrs. Sidebottom motioned to adopt Municipal Order 2011-2 and seconded by Mr. Jefferson. Motion carried unanimously by show of hands.

COUNCIL REPORTS

Mr. Scott reported soccer is going well in the park with baseball, t-ball and softball getting started, too. Now that the Day of Service Project is complete, plans are to start working on completely renovating the concession and restroom building.

Mr. Jefferson called for a report from Police Chief Marklin. Chief Marklin introduced Officer Mark Nichols who was hired in November 2010 and Officer Monte Strode who was hired in March 2011. Both officers have many years of experience working for Christian County and Hopkinsville Police Department (both officers thanked the council and left the meeting). Chief Marklin reported department activity last month.

Mr. Laster reported that the water loss in the city was 4.9% last month after repairing the large leak in Laster Trailer Park, drawing applause from the council. The average loss has been about 38% per month over the last few years. Mr. Frogue stated this is a savings to the department of about $9,000 this month. Mr. Frogue stated he would like to see a few more months’ worth of figures before getting too excited, but the figures are promising. Frogue reported the contractor on the West Main Street and Highway 68/80 sewer extensions is set to get started on April 25th. Plans for the Commerce Street sewer line extension have been sent to the state for approval and the project will be bid out the first week of May. Frogue also reported that Mr. Arland Overholt is beginning construction at the Riverbend Subdivision. Mr. Laster expressed his gratitude to Terry Frogue, who volunteered many hours during the Day of Service Project and Kick Off event.

Mr. Powell asked if the dates for the annual spring clean up have been set. Mayor Camp stated the clean up will be in May, but the exact dates have not been set yet.

MAYOR’S REPORT

Mayor Camp reported she learned at the PADD meeting today that the unemployment rate in Todd County was 11.5% last month.

Mayor Camp reported the 2010 Census figures show that Elkton’s population increased by 4% to a total population of 2,062.

The dedication for the Milliken Memorial Community House Historical Marker will be held on Tuesday, April 12th at 5:00 PM.

The Todd County Industrial Foundation is holding an open breakfast meeting on Wednesday, April 13th at 8:00 am at Refine Tile to discuss high school technical training and to get a tour of the facilities.

Mr. Kirkham is going to contact Parson’s Engineering to discuss a possible study of inside the Elkton Die Casting building. Mayor Camp has not talked to Mr. Boley or Mr. Settle about using the building for an adult training center since the last meeting, but we will continue to work on the Die Casting property for future use.

Mayor Camp called the meeting to order at 5:00 PM and reminded the council only items on the agenda can be discussed.

Agenda

1. Elkton Die Casting Property / Training Center

Mayor Camp welcomed all guests and gave the floor to Donald Settle to discuss the possibility of using the Elkton Die Casting property for an adult training facility. Mr. Settle stated he and Garth Camp have looked at the building and are working on estimates to rewire the building, since vandalism has destroyed much of the wiring. He and others, including Doug Boley, are ready to start cleaning up the building and using it as an adult training and retraining facility offering classes in machine work, welding, electrical, interview skills, resume writing and more. The group would only ask the city to pay for the electric bill, which he estimates would just be the base rate. Pennyrile Electric may require a five year contract since the building needs three phase service, however this may be waived since this will be a nonprofit, job creating project. Mr. Settle thinks a lot of the work to get the building cleaned up would be donated, but if there are funds that are needed he will have to come to the city and it would need to be worked out then or the project could be stopped. There was also discussion about liability insurance and who would be responsible for the volunteers and students. Mr. Kirkham informed the group that there is an environmental covenant on a portion of the outside of the property. There was considerable discussion that the inside of the building needs to be tested for any possible contamination. Mr. Kirkham stated the city has discussed using the engineering firm that helped develop the plan to clean up the outside of the building for any future clean up efforts. Mayor Camp stated that it has been advised that the city clean up the inside of the building first and then have the inside tested. Mr. Settle and Mr. Boley stated they would be willing to help clean the building, however there was discussion about needing the building cleaned by a professional in case there was contamination. Mr. Settle stated that it may take a year to get the building ready for use, but we have to start somewhere. He also stated that he may start looking for another building and believes that a training center should be centrally located near Elkton. Everyone expressed that this is a great project and supports the idea. Mayor Camp suggested everyone continue working on this project and the city will hold another meeting when we know more about what it will take to clean and inspect the building.

There were no other items on the agenda and therefore Mr. Laster motioned to adjourn and seconded by Mr. Gibson. Motion carried unanimously and meeting adjourned at 6:00 PM.

The Elkton City Council met in regular session on Monday, March 14, 2011 with Mayor Nancy T. Camp presiding.

Mayor Camp called the meeting to order at 7:00 PM and led the Pledge of Allegiance. Chief Marklin gave invocation.

After reviewing the minutes of the February 14, 2011 regular council meeting, minutes of the February 23, 2011 special council meeting, bills payable and financial reports, Mr. Powell motioned to approve. Motion seconded by Mr. Gibson and carried unanimously.

Clerk Brock read first reading of Ordinance 2011-2, “ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ELKTON, KENTUCKY DEALING WITH THE ELKTON-TODD COUNTY RECREATION COMMISSION.” Mr. Jefferson motioned to approve after first reading and seconded by Mr. Gibson. Motion carried unanimously.

Clerk Brock read first reading of Ordinance 2011-3, “AN ORDINANCE REPEALING §35.015 OF THE CODE ORDINANCES OF THE CITY OF ELKTON, WHICH ESTABLISHED A PARKS AND RECREATION ADMINISTRATION COUNCIL.” Mr. Powell motioned to approve after first reading and seconded by Mr. Gibson. Motion carried unanimously.

Clerk Brock read first reading of Ordinance 2011-4, “AN ORDINANCE AMENDING SECTION 52.04(A) OF THE CODE OF ORDINANCES OF THE CITY OF ELKTON ADJUSTING AND MODIFYING USER RATES FOR WASTEWATER SERVICES IN THE CITY OF ELKTON.” Mr. Gibson motioned to approve after first reading and seconded by Mr. Scott. Voting in favor of the motion were Gibson, Jefferson, Scott, Powell and Sidebottom. Voting opposed was Laster. Motion carried.

Mayor Camp reported she received a letter of resignation from Bryan Mason from the Recreation Commission. Mr. Scott motioned to accept the resignation and seconded by Mr. Jefferson. Motion carried.

Clerk Brock, Mr. Laster and Mr. Scott updated the council on the Day of Service volunteer project in the City-County Park. Mr. Laster stated that we are mostly relying on local volunteers on the Kick Off Day scheduled for March 26th. Most of the volunteers on the Day of Service on April 9th will be from the Church of Jesus Christ of Ladder-day Saints.

COUNCIL REPORTS

Mr. Jefferson called for a report from Police Chief Marklin. Chief Marklin reported department activity last month. Also, the department has been advertising for a police officer position since Officer Bobby Miller is no longer with the city. The department will now need to hire two officers, because Officer Rocky Barr just informed the Chief he has accepted a position with the Todd County Sheriff.

Mr. Scott reported that spring soccer has started in the park and that baseball and softball will be starting soon. The Recreation Commission also has all appointed positions filled.

Mr. Laster called for a report from Mr. Frogue. Frogue reported that it appears from the usage reports from Logan-Todd Regional Water that the city’s usage is down after the large leak was fixed at the end of February. We will know more when we have a full month’s usage report. Also, at the end of the week some of the larger water meters will be tested in the ground to check for accuracy. Finally, Frogue reported the need to start thinking about water tanks that needed painting and repaired.

Powell reported only one fire run last month, which was to South Todd Elementary for a bomb threat.

Mr. Gibson reported a large pothole behind Max Fuel adjacent to Streets Avenue. The Utility Department will fill in the hole with gravel.

MAYOR’S REPORT

Mayor Camp announced that Mediacom will be adding a “country tv” channel 115 to the service effective April 13th at no additional cost.

Mayor Camp received a request for the annual donation to Project Graduation. Mr. Laster motioned to contribute $250 and seconded by Mrs. Sidebottom. Motion carried unanimously.

Mayor Camp announced the 2010 Census figures will be released this week.

Mayor Camp reported the Todd County Community Alliance is holding an “Eggstravaganza” event in Elkton from April 28th to April 30th. They would like the city to sponsor a carnival during this event. Mayor Camp presented a proposal from Great American Shows from Madisonville. She has spoken with the operator of the show to work out the details. The city will provide the Elkton Die Casting lot, security, water service and garbage pickup. The company would keep all proceeds from concessions with a certain percentage of rides donated to the city. After all city expenses are paid, remaining proceeds would be donated to the Todd County Community Alliance. After discussion, Mr. Powell motioned to contract with Great American Shows for the carnival. Motion seconded by Mr. Laster and carried unanimously.

Mr. Laster motioned to adjourn and seconded by Mr. Scott. Motion carried unanimously and meeting adjourned at approximately 8:30 PM.

Todd County represented in donated $400,000 Kentucky State Capitol pendentive murals

ELKTON, Ky., (May 17, 2010) Todd County, Kentucky will be permanently represented in the rotunda of the Kentucky State Capitol after a project to complete the dome pendentive murals was announced by First Lady Jane Beshear last week.

A donation by Terry & Marion Forcht of Corbin, Kentucky funded the two year project and the four murals will be revealed on June 4th & 5th in a two-day celebration, in time for the 100 year celebration of the Kentucky State Capitol building. The Jefferson Davis Monument, a Todd County landmark, is represented in the mural named, "Civitas, the light of progress." A description of the mural establishes that the monument was represented in the mural to commemorate Kentucky's participation in the United States Civil War. The public is invited to participate in the unveiling of the murals. Invitations to the June 4th gala event are being mailed this week.

The Elkton Tree Board is composed of seven members appointed by the City Council. The tree board meets regularly to, among other duties, plan and discuss the planting of new trees and the maintenance of existing trees. The Tree Board sponsored the construction of a 0.4 mile walking trail in the City-County Park. The trail is currently being prepared to be fully concreted through grant funding through the State Parks. The trail is adorned by various planted trees, each being marked with a sign stating its common name and species. Also, the Tree Board received grant funding for the installation of several exercise stations along the trail and for the purchase of two gazebos.

Code Enforcement Board

The Code Enforcement Board was created by the City in 2003. The creation of a CEB was authorized by the State of Kentucky to allow local governments to issue remedial orders and to impose civil fines as an inexpensive alternative to ensure compliance with local ordinances. The only other alternative a City has to enforce local ordinances is to take the case to court, which takes a lot of time and money for both the City and the offender.

First, a Citation Officer will issue a Notice of Violation to an offender. This Notice will explain the violation and how to correct it. The Notice will also give a date by which time the violation shall be corrected. If the violation is not corrected by the date on the Notice, the Citation Officer will then issue a Citation charging the offender with a civil offense. The Citation gives the offender two choices. First, the offender may not contest the citation and, within seven days, pay a small penalty and correct the violation by a given date. Second, the offender may contest the violation and, within seven days, request a hearing before the CEB.

If the offender chooses to have a hearing, and is found to have committed the violation, a larger penalty will be imposed by the CEB (usually double the fine if the violation is not contested.) If the offender requests a hearing, the CEB will hold a public hearing to receive evidence of the violation. The offender will also have the opportunity to present their case. After receiving all evidence and testimony, the CEB may issue orders necessary to remedy a violation and may impose civil fines.

Elkton City Hall Staff

Laura Brock, City Clerk/Treasurer, began working with the City part-time in May 1997. Laura was hired full-time in August 1997 and was appointed City Clerk/Treasurer in May 1998. Annual Occupational License Tax Return
Annually, each business must file an Occupational License Tax Return based on work performed during the preceding year. The license fee is equal to 0.125% (.00125) of gross receipts from sales, services rendered or work done in the city. Please note that this License Fee is based on GROSS receipts, not net profits. Payment of the License Fee, along with the completed renewal form with attached federal tax return forms is due on or before April 15th of each year for businesses operating on a calendar year. If the business entity operates on a fiscal year other than calendar year, then the return is due on or before the 15th day of the fourth month following the close of the business entity's fiscal year.

Request to Close Business License Account

The Occupational License Tax Return must be filed every year until a Request to Close Business License Account form is filed with the City. This form certifies that all operation of business in the City has ceased. However, closing the account shall in no way relieve the business from any business license fees due to the city currently, or in the future, from being paid. When a business is closed, a Occupational License Tax Return based on gross receipts earned for work done in the year the business closed must be filed with the Request to Close Business License Account.

Occupational License Tax on Payroll

Pursuant to City Ordinances there is also a license fee equal to 2.0% of all gross salaries, wages, commissions and other compensations earned for work done or services performed in the city by every employee, officer or agent of the business.

Employer's Quarterly Return of Occupational License Fee Withheld

It is the duty of each employer to deduct the license fee from each employee, officer or agent at the time of payment. The license fee withheld shall be submitted with the Employer's Quarterly Return of Occupational License Fee Withheld on a quarterly basis and is due to the City by the last day of the month following the end of the quarter.

Annual Reconciliation

Annually, each employer must also file an Annual Reconciliation of occupational license tax on payroll and submit a copy of all W-2s issued and totals page form W-3. In lieu of copies of W-2s, a payroll listing that shows each employee's gross wages and occupational tax withheld may be submitted along with a copy of form W-3. The Annual Reconciliation is due to the city by the last day in February.

1099 Form Submittal

Per City Ordinance, all business entities are required to submit to the City of Elkton all 1099’s issued for work done in the City. If the business is physically located in Elkton, please submit all Federal Form 1099’s issued. If the business is not physically located in Elkton, you may submit only the 1099's for work physically performed in Elkton. Please use the 1099 Form Submittal to submit all 1099s issued.
